Terms of Service

1. Definitions

  • "Client", you, or user: means any individual or entity using the Services.
  • "Account": means the workspace or instance registered by you or your organization on messagingme.app.
  • "Content": means all data, text, files, or media transmitted through or stored in the Services.
  • "Third-party integrations": means any external services connected to MessagingMe (e.g. WhatsApp Business API, Facebook, HubSpot, Salesforce, etc.).

2. Service Description

MessagingMe provides a SaaS platform that enables companies to:

  • Automate customer conversations across messaging channels (WhatsApp, Instagram, Facebook Messenger, etc.);
  • Manage, track, and analyze interactions;
  • Integrate messaging flows with CRMs or other business tools.

The Services may evolve over time. We reserve the right to modify or improve features, interfaces, and integrations without prior notice.

3. Eligibility

To use MessagingMe:

  • You must be at least 18 years old (or the legal age in your jurisdiction).
  • You must have the authority to accept these Terms on behalf of the entity you represent.
  • You must provide accurate and complete information when creating your account.

4. Account Responsibilities

You are responsible for:

  • Maintaining the confidentiality of your credentials;
  • All activities that occur under your account;
  • Ensuring that your use of the Services complies with applicable laws, including data protection and anti-spam regulations.

If you suspect unauthorized use, you must immediately notify us at contact@messagingme.fr.

5. Acceptable Use Policy

You agree not to use MessagingMe to:

  • Violate any applicable laws or regulations;
  • Send spam, phishing, or any unsolicited content;
  • Transmit offensive, defamatory, or illegal content;
  • Disrupt or interfere with the proper functioning of the platform;
  • Attempt unauthorized access to systems or data of other users.

6. Customer Data and Privacy

Your data belongs to you. We act only as a processor.

You retain all intellectual property and ownership rights to your Content. MessagingMe does not claim any ownership over your data.

We will process personal data in accordance with our Privacy Policy and applicable data protection laws (GDPR, etc.).

You are responsible for the legal compliance of your use of the Services, including obtaining necessary consents from your contacts.

7. GDPR Compliance

If you are subject to GDPR:

  • You act as the data controller for your customer data;
  • MessagingMe acts as the data processor;
  • A Data Processing Agreement (DPA) can be provided upon request.

8. Payment and Billing

Pricing is available at messagingme.app/pricing. It may be changed with 30 days' notice.

You will be billed according to your chosen plan (monthly or annual). All payments are non-refundable unless otherwise stated.

In case of non-payment, we reserve the right to suspend or terminate your access to the Services.

9. Intellectual Property

All rights, titles, and interests in the MessagingMe platform (software, trademarks, logos, documentation, etc.) remain the property of MessagingMe.

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services during your subscription.

10. Service Availability

We strive to ensure high availability, but:

  • We do not guarantee uninterrupted operation;
  • Scheduled or emergency maintenance may occur;
  • We are not responsible for outages due to third parties (e.g. messaging providers, hosting).

11. Limitation of Liability

To the fullest extent permitted by law:

  • MessagingMe will not be liable for indirect, special, incidental, or consequential damages;
  • Our total liability will not exceed the amount paid by you in the last 12 months;
  • We are not responsible for data loss due to your actions or omissions.

12. Termination

You may terminate your account at any time from your account settings or by contacting us.

We reserve the right to suspend or terminate your access in case of violation of these Terms, non-payment, or suspicious activity.

Upon termination, your access will be removed and your data may be deleted in accordance with our retention policy.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes by email or through the platform. Continued use after changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the United Arab Emirates. Any disputes will be subject to the exclusive jurisdiction of the courts of Dubai.
